SUBJECT: A PUBLIC HEARING TO CONSIDER ADOPTION OF A RESOLUTION TO ESTABLISH UNDERGROUND UTILITY DISTRICT NO. 18 ON MILLIKEN AVENUE BETWEEN 600 FEET NORTH OF GUASTI ROAD AND AIRPORT DRIVE


RECOMMENDATION: That the City Council conduct a public hearing to consider adoption of a Resolution establishing Underground Utility District No. 18 on Milliken Avenue between 600 north of Guasti Road and Airport Drive.

FISCAL IMPACT: The above mentioned underground utility district will be funded with Rule 20A funds. Rule 20A funds are collected and held by Southern California Edison (SCE) and distributed to city projects on an apportionment basis. Currently, Ontario is allocated approximately $401,000 per year from SCE for utility undergrounding projects. There is no impact to the City’s General Fund.

 

BACKGROUND: The City Council at its January 20, 2009 meeting, adopted a resolution to set a public hearing for Tuesday, February 3, 2009 to consider establishing an underground utility district along Milliken Avenue between 600’ north of Guasti Road and Airport Drive. All adjacent property owners and affected utility companies have been properly notified of the public hearing. Each year Southern California Edison (SCE) is required by Rule 20A of the Public Utilities Commission to budget funds for replacing overhead electric facilities with underground facilities along public streets and roads. This undergrounding work, performed and paid for by SCE, is restricted to streets with heavy volumes of vehicles or pedestrians, streets in civic or public recreation areas, streets with unusually scenic interest, or areas of an unusually heavy concentration of overhead facilities. These funds are apportioned to the various cities based on the ratio of overhead meters within the city to the total overhead meters in the system. The attached Boundary Exhibit has been modified since the January 20, 2009 City Council action. The modification was made at the request of SCE to include the eastern half of Milliken Avenue along the boundary limits. The modification is needed to ensure that future utilities on both sides of Milliken Avenue, within the boundary limits, shall be undergrounded. All affected property owners were notified of the boundary change.
