RESOLUTION AUTHORIZING THE FILING OF A GRANT APPLICATION FOR CALIFORNIA PUBLIC UTILITIES COMMISSION – SECTION 190 FUNDS TO CONSTRUCT THE NORTH MILLIKEN AVENUE GRADE SEPARATION AT THE UNION PACIFIC RAILROAD (UPRR) TRACKS

SUBJECT: A RESOLUTION AUTHORIZING THE FILING OF A GRANT APPLICATION FOR CALIFORNIA PUBLIC UTILITIES COMMISSION – SECTION 190 FUNDS TO CONSTRUCT THE NORTH MILLIKEN AVENUE GRADE SEPARATION AT THE UNION PACIFIC RAILROAD (UPRR) TRACKS

 


RECOMMENDATION: That the City Council adopt a resolution authorizing the filing of a grant application to obtain $5 million of California Public Utilities Commission (CPUC) – Section 190 funds for the construction of the North Milliken Avenue Grade Separation; and authorize the City Manager to execute a Construction and Maintenance Agreement with UPRR.

 

COUNCIL GOALS: Develop Strategies And Take Actions To Minimize The Negative Impacts Of The Global Financial Downturn On Ontario’s Economy And The City’s Fiscal Health Invest In The City’s Infrastructure (Water, Streets, Sewers, Parks, Storm Drains And Public Facilities)

 

FISCAL IMPACT: The City’s spending plan for the $74.2 million North Milliken Avenue Grade Separation Project includes funding from: the State’s Traffic Congestion Relief Program (TCRP), Trade Corridor Improvement Fund (TCIF), Measure I, a cost-sharing agreement with the UPRR, SCE Rule 20A and local matching funds from Development Impact Fees. If the City is successful in obtaining the $5 million CPUC - Section 190 funds, the Measure I portion of funding for the project will be reduced by $4 million and the City’s local match will be reduced by $1 million.

 

BACKGROUND: The construction of a railroad grade separation at Milliken Avenue and the UPRR crossing will relieve traffic congestion, improve vehicular safety, and enhance regional cargo and goods movement. The State TCRP established by AB2928 provides State funding toward Alameda Corridor -East Grade Separation projects including the North Milliken Avenue Grade Separation Project. On September 24, 2008 SANBAG entered into a Funding Agreement to provide Ontario with a loan in the event that the City is unable to provide the required 20% local matching funds at the time of project construction. The project’s local match is estimated to be $13 million; and if the City is awarded the $5 million CPUC - Section 190 funds, the Measure I portion of funding for the project will be reduced by $4 million and the City’s local match will be reduced by $1 million.

 

In order for the City to qualify for a grant allocation from the “2008/09 CPUC Railroad Grade Separation Priority List”, a new Construction and Maintenance Agreement between the City and UPRR must be executed. Staff is coordinating with UPRR to complete the agreement prior to the grant submittal deadline. The 2008/09 Grade Separation Funds application to the CPUC must be submitted by April 1, 2009.
