AMENDMENT TO A PROFESSIONAL SERVICES AGREEMENT FOR ON-CALL MATERIAL TESTING AND GEOTECHNICAL SERVICES |
RECOMMENDATION: That the City Council approve an amendment to the Professional Services Agreement (on file in the Records Management Department) with Ninyo & Moore, a Corporation, of Rancho Cucamonga, California, for additional on-call material testing and geotechnical services in the amount of $100,000 and authorize the City Manager to execute said amendment and related documents.

FISCAL IMPACT: Appropriations for necessary material testing and geotechnical services are included in the individual budgets for the various capital improvement projects.
BACKGROUND: On October 19, 2006 the City entered into a three year agreement with Ninyo & Moore, of Rancho Cucamonga, California, to provide material testing and geotechnical services on an as-needed basis for various projects under the City’s Capital Improvement Program. The maximum annual compensation under the original agreement is $100,000. Due to an increased demand from the capital projects in the current fiscal year; extensive use of material testing and geotechnical services on the 4,000 foot long, 20 foot deep, Holt Trunk Sewer-Phase B; and emergency repair work at Grove Avenue and Francis Street, it is recommended to increase the Fiscal Year 2008-09 authorization by $100,000. Staff has renegotiated the contractor’s fee schedule to eliminate certain reimbursable expenses; and labor rates were reduced by a minimum of 10% across all categories for the remainder of the agreement term.
